An equipment rental agreement governs the short-term hire of tools, machinery, vehicles or other equipment from an owner to a renter. It covers the rental period, rate, deposit, condition at handover, permitted use, maintenance responsibilities, damage/loss liability and insurance.

Equipment rental carries significant liability risk — the renter operating heavy equipment can cause injury or property damage. Include insurance/indemnity language and ensure the renter is competent/qualified for the equipment.

What to include#

  • Owner and renter. Owner name/company; renter name/company; addresses and contact details; driver's license/ID if relevant.
  • Equipment and rental term. Description of equipment (make, model, serial/VIN, accessories), pick-up/delivery date, return date, and location of use.
  • Rates and charges. Daily/weekly/monthly rate, minimum charge, security/damage deposit, fuel/cleaning fees, late-return fees and delivery/pick-up charges.
  • Condition and use. Condition at handover (attach a condition report/photos), permitted use, prohibited uses, who operates it, and maintenance responsibilities (daily checks by renter; major repairs by owner).
  • Liability and insurance. Renter responsibility for damage, loss and theft; insurance required (and certificate); indemnification; owner disclaimer of liability for renter's use; security deposit return terms.

How to fill it in#

  1. Step 1: Inspect and photograph

Walk around the equipment with the renter, note existing damage on a condition sheet and take dated photos.

  2. Step 2: Verify qualifications

Check licenses/certifications for specialised equipment (e.g. forklifts, heavy machinery) and confirm insurance coverage.

  3. Step 3: Set rates clearly

State rate, billing increments, late fees, fuel policy and deposit; clarify minimum rental periods.

  4. Step 4: Agree on damage responsibility

Make clear the renter pays for damage, theft, or loss during the rental period (subject to normal wear); require a deposit.

  5. Step 5: Sign and hand over

Both sign; renter receives the equipment and a copy; owner files the agreement and condition report. Inspect again on return.

Questions

Do I need insurance?

Owner should carry commercial/equipment insurance and require renters to carry liability coverage; ask for a certificate of insurance.

Who pays for repairs?

Renters are usually responsible for damage caused by misuse, accident or neglect during the rental; owners cover normal wear and mechanical failure.

How much deposit?

Typically 10-25% of the equipment value or one day rental rate; refund within a set period after return minus damage/loss/fuel.

Can I rent to an unlicensed operator?

For equipment requiring a license (vehicles, forklifts, certain heavy machinery) no — verify credentials before handover.

What if equipment is returned late?

Charge the daily rate plus a late fee per the agreement; specify in advance.
