EQUIPMENT RENTAL AGREEMENT
This Equipment Rental Agreement (the "Agreement") is made on [Agreement date] between [Owner name], [Owner address] (the "Owner"), and [Renter name], [Renter address] (the "Renter").
1. Equipment
The Owner rents the following equipment, with any manuals, accessories and attachments supplied with it (the "Equipment"), to the Renter:

2. Rental period
The rental starts on [Rental start date] and ends on [Rental end date], when the Equipment must be returned for collection by the Owner from [Delivery address]to the Owner at [Return location]. A late return is charged at [Late return fee] for each day or part of a day it is late.
3. Rent and deposit
The rent is [Rental rate] per [Charged per], a total of [Rental total] for the rental period, payable [Rent due terms]. Delivery and collection cost [Delivery fee].
The Renter pays a security deposit of [Deposit amount] before the rental starts. The Owner returns it within [Deposit return days] days after the Equipment is returned, less any amounts the Renter owes under this Agreement, with a written list of any deductions.
4. Condition and use
- The Renter has inspected the Equipment and accepts that it is in good working order, except for: [Existing damage notes].
- The Renter will use the Equipment only for [Permitted use], only at [Equipment location] unless the Owner agrees otherwise in writing, and only in a careful and proper way, following the manufacturer's instructions.
- The Equipment will only be operated by the Renter or by people the Renter has checked are trained and, where required, licensed to operate it.
- The Renter will not sell, sublet, lend or modify the Equipment, or allow any lien or charge to be placed on it.
- The Renter will stop using the Equipment and tell the Owner promptly if it breaks down or becomes unsafe, and will not have it repaired by anyone else without the Owner's consent.
5. Loss and damage
The Equipment is at the Renter's risk from when it is handed over until it is returned. The Renter pays for repairing any damage other than normal wear and tear and, if the Equipment is lost, stolen or cannot be repaired, its replacement cost listed above.
The Renter will insure the Equipment against loss and damage for at least its replacement cost, and carry liability insurance of at least [Insurance amount], for the whole rental period, and will provide proof of insurance before the rental starts.
6. Liability
The Renter is responsible for the use of the Equipment and will hold harmless and indemnify the Owner against claims by others arising from that use, except to the extent caused by the Owner's negligence or a defect in the Equipment that the Owner knew about. The Owner is not liable for the Renter's lost profits or other indirect loss caused by a breakdown.
7. General
The Owner may end this Agreement and take back the Equipment if the Renter does not pay on time or breaks this Agreement. This Agreement is governed by the laws of [Governing law].

Questions
What should an equipment rental agreement include?
A list of the equipment with serial numbers and values, the rental dates, the rate, any deposit, how it is delivered and returned, what it may be used for, who pays for damage or loss, and whether the renter must insure it.
Who pays if rented equipment is damaged?
Under this template the renter pays for damage beyond normal wear and tear, and the replacement cost if it is lost or stolen, because the equipment is at the renter's risk while they have it. Record any existing damage at handover, with photos, to avoid disputes.
Should I take a security deposit?
A deposit covers small damage and late fees without chasing the renter. Say when it is returned and that deductions will be itemized. For valuable equipment, ask for proof of insurance as well.
Is it really free?
