LEASE TERMINATION AGREEMENT

This Lease Termination Agreement is made on [Agreement date] between [Landlord name] (the "Landlord") and [Tenant names] (the "Tenant"), about the lease dated [Lease date] for [Property address] (the "Lease").

1. Early end of the Lease

The Landlord and the Tenant agree that the Lease ends on [Termination date] (the "Termination Date"), before the end of its term. The Tenant will move out, remove all belongings and return all keys, fobs and remotes by then.

2. Rent and fees

The Tenant pays rent up to and including the Termination Date. The Tenant also pays a lease termination fee of [Termination fee], due by [Termination fee due date]. No rent is due for any period after the Termination Date.

3. Security deposit

The Landlord holds a security deposit of [Deposit amount]. After the Tenant moves out, the Landlord will return it, less only the deductions the Lease and the law allow, with an itemized list of any deductions, within the time the law requires, to this forwarding address: [Forwarding address].

Until the Termination Date, the Landlord may show the property to prospective tenants after giving the Tenant at least [Showing notice hours] hours' notice.

4. Release

Once the Tenant has moved out and paid what this Agreement requires, the Landlord and the Tenant release each other from all further obligations under the Lease, except the return of the security deposit and any claim for damage beyond normal wear and tear found at the move-out inspection.The Lease continues to apply until the Termination Date. This Agreement changes only its end date and the payments set out above.

5. General

This Agreement is governed by the law of the place where the property is located. If the Tenant does not move out by the Termination Date, the Landlord keeps every right it has under the Lease and the law.

Questions

Can a tenant end a lease early?

Only with the landlord's agreement or a legal right to do so. Many states let tenants end a lease early for reasons such as military service or domestic violence, and many require the landlord to try to re-let a home a tenant leaves early. An agreement like this one settles it in writing.

Is a lease termination fee legal?

Usually, if both sides agree to it. A common fee is one or two months' rent, which the landlord accepts instead of trying to collect rent for the rest of the term.

Is this the same as a notice to vacate?

No. A notice to vacate is a tenant's one-sided notice to leave when the lease or notice period allows it. A termination agreement is a deal both sides sign to end the lease early.
