RELEASE AND WAIVER OF LIABILITY

PLEASE READ THIS DOCUMENT CAREFULLY BEFORE SIGNING. IT AFFECTS YOUR LEGAL RIGHTS.

This Release and Waiver of Liability (the "Waiver") is signed on [Signed date] by [Participant name] (the "Participant") in favor of [Organizer name], [Organizer address] (the "Organizer").

1. The activity

The Participant wishes to take part in [Activity description] at [Activity location] on [Event date], on any date on which the Participant takes part, including any related instruction, equipment use, travel between sites and other associated activities (together, the "Activity").

2. Risks

The Participant understands that the Activity involves risks, including risks that cannot be removed without changing the nature of the Activity. They include:

Other risks may be unknown or not reasonably foreseeable. The Activity may result in minor injuries, serious injuries such as broken bones, paralysis or death, and loss of or damage to property.

3. Assumption of risk

The Participant takes part voluntarily and, to the extent the law allows, accepts all the risks of the Activity, whether described above or not. The Participant agrees to follow the rules and instructions of the Organizer and its staff, to use any safety equipment provided, and to stop taking part and tell a member of staff if they notice a hazard or feel unwell.

4. Health

The Participant confirms that they are physically fit to take part in the Activity and know of no medical or other condition that makes it unsafe for them to do so, other than the conditions listed below, which they have told the Organizer about.

If the Participant is injured or becomes ill, they authorize the Organizer to call for or arrange emergency medical treatment, including transport to hospital, if the Organizer reasonably believes it is needed. 5. Release of liability

In exchange for being allowed to take part in the Activity, the Participant, for themselves and their heirs, personal representatives and assigns, releases and discharges the Organizer and its owners, officers, employees, volunteers, agents and contractors (the "Released Parties") from all liability for any injury, illness, death, loss or damage that the Participant suffers in connection with the Activity, INCLUDING LIABILITY CAUSED BY THE NEGLIGENCE OF THE RELEASED PARTIES, and agrees not to sue them for it.

This release does not apply to gross negligence, recklessness or intentional misconduct, or to any liability that the law does not allow to be excluded or limited. In some places, including the United Kingdom, liability for death or personal injury caused by negligence cannot be excluded, so this release does not apply to that liability there.

The Participant will repay the Released Parties for any claim made against them by someone else, and the reasonable costs of dealing with it, to the extent the claim is caused by the Participant's own negligent or deliberate acts during the Activity.

The Organizer may take photos and video during the Activity that include the Participant, and may use them to promote its activities, without payment.

6. General

This Waiver is intended to be as broad as the law of [Governing law] allows, and is governed by that law. If any part of it cannot be enforced, the rest remains in effect. It applies to every occasion on which the Participant takes part in the Activity.

Questions

Are liability waivers enforceable?

Often, in most US states, if the waiver is clear, lists the risks, says plainly that it covers negligence and is signed voluntarily. No waiver covers gross negligence or intentional harm, and a few states, including Louisiana, Montana and Virginia, refuse to enforce waivers of personal injury claims. In the UK, a business cannot exclude liability for death or personal injury caused by its negligence.

Can a parent sign a waiver for a child?

A parent can consent and accept the terms, but many US states will not enforce a parent's waiver of a child's own injury claims, especially against a commercial business. The parent section still records their consent and that they were told the risks.

Is a liability waiver the same as a release?

No. A waiver is signed before an activity, for injuries that have not happened yet. A release is signed after something has gone wrong, usually for a payment, to settle claims that already exist. Use the general release template for that.

Is it really free?
