PHOTOGRAPHY AGREEMENT

This Photography Agreement is made on [Effective date] between [Photographer name] (the "Photographer") and [Client name] (the "Client").

1. The shoot

The Photographer will photograph [Shoot description] on [Shoot date] at [Shoot location], providing [Coverage hours] hours of coverage with a second photographer.

2. What the Client receives

The Photographer will deliver about [Image count] edited digital images through an online gallery within [Delivery days] days of the shoot.

The package also includes the following prints:

  • [Print quantity] × [Print size]

3. Fees and payment

The total fee is [Total fee]. A retainer of [Retainer amount] is due on booking to reserve the date, and the balance is due [Balance due days] days before the shoot. Travel beyond [Travel radius] is charged at [Travel rate].

4. Cancellation and rescheduling

If the Client cancels less than [Cancellation days] days before the shoot, the retainer is not refunded. The Photographer will try to accommodate a new date, subject to availability.

If the Photographer cannot attend because of illness or events beyond their control, they will try to arrange a suitable replacement; if they cannot, they will refund all payments received, and that refund is the limit of their liability.

5. Copyright and use of the images

The Photographer owns the copyright in the images. The Client may use the images for commercial purposes, limited to [Usage scope].The Client may print, share and post the images for personal, non-commercial use.

The Photographer may use selected images in their portfolio and marketing.

6. Governing law

This Agreement is governed by the laws of [Governing law].

Questions

Who owns the copyright in the photos?

In most countries the photographer owns the copyright unless they sign it away. This template keeps copyright with the photographer and gives the client a personal or commercial licence, which is the usual arrangement.

Is the retainer refundable?

In this template the retainer is kept if the client cancels within the cancellation window, because the date was reserved for them. Consumer protection rules in some places limit non-refundable deposits, so check what applies to you.

Is it really free?
