CATERING CONTRACT

This Catering Contract is made on [Agreement date] between [Caterer name] (the "Caterer") and [Client name] (the "Client").

1. The event

The Caterer will cater the Client's [Event type] on [Event date] at [Event location], from [Service start time] to [Service end time], for about [Guest count] guests. The Client will confirm the final guest count at least [Final count days] days before the event; the Client pays for the confirmed count even if fewer guests attend.

2. Menu and service

Repeated for each menu item

Service style: [Service style], with [Staff count] staff. Dietary needs to accommodate: [Dietary notes]. The Caterer will label dishes that contain common allergens on request, but cannot guarantee a kitchen free from allergens.

Alcohol will be served by [Alcohol service by]. Staff will refuse service to anyone underage or visibly intoxicated.

3. Price and payment

The price is [Price per guest] per guest, plus a service charge of [Service charge percent]%, plus any applicable tax. A deposit of [Deposit amount] is due on signing to reserve the date, and the balance is due [Balance due days] days before the event.

4. Cancellation and changes

If the Client cancels more than [Cancellation days] days before the event, the deposit is kept and nothing more is owed. If the Client cancels later, the Client also pays for food and staff the Caterer has already committed to. Menu changes are possible up to the final count deadline, and may change the price.

5. Venue, food safety and leftovers

The Client will arrange access to the venue, a suitable preparation area and any permits the venue requires. The Caterer follows food safety law and its own insurance requirements; for safety reasons, food that has been served may not be taken away unless the Caterer agrees.

6. Liability

The Caterer carries liability insurance and is responsible for its own staff and equipment. The Client is responsible for damage caused by guests. Neither party is liable for failure caused by events beyond its reasonable control, in which case the deposit is refunded less costs already incurred. This Contract is governed by the laws of [Governing law].

Questions

What should a catering contract include?

The event details, the menu, the guest count and when it becomes final, the price and what it includes, the deposit and payment dates, who serves alcohol, cancellation terms, and who is responsible for the venue, equipment and damage.

How much deposit should a caterer take?

Many caterers take 25% to 50% on booking to hold the date, with the balance due a week or two before the event, once the final guest count is set.

Is a service charge the same as a tip?

Not necessarily. A service charge is part of the price and in some places is not passed to staff. Say in the contract what it covers so clients know whether to tip.

Is it really free?
