ROOM RENTAL AGREEMENT

This Room Rental Agreement is made on [Agreement date] between [Owner name] (the "Owner") and [Tenant name] (the "Tenant") for a room in the home at [Property address] (the "Home").

1. The room and shared areas

The Tenant rents [Room description], furnished with [Furniture list], for their own use. The Tenant may also use these shared areas: [Shared areas]. The Tenant may park one vehicle at [Parking details].

2. Term

The Tenant moves in on [Move in date]. The agreement ends on [End date], unless both agree in writing to extend it.The agreement continues month to month, and either side may end it by giving [Notice days] days' written notice.

3. Rent and deposit

Rent is [Monthly rent] a month, due on day [Due day of month] of each month, paid by [Method of paying]. Rent paid more than [Late fee grace days] days late incurs a late fee of [Late fee amount], where the law allows. The Tenant pays a security deposit of [Deposit amount], which the Owner returns within the time the law requires after the Tenant moves out, less only lawful deductions with an itemized list.

4. Utilities

Rent includes these utilities: [Included utilities].The Tenant pays [Utility share percent]% of the household utility bills within [Utility payment days] days of being shown each bill.

5. House rules

The Tenant will keep the room and shared areas clean, respect quiet hours of [Quiet time], and follow these house rules: [House rules]. Guests may stay overnight for up to [Guest nights count] nights a month. Pets are allowed with the Owner's written approval.No pets are allowed. Smoking and vaping are not allowed inside the Home.

6. Access and repairs

The Owner may enter the room for repairs or inspections after giving at least [Entry notice hours] hours' notice, or at once in an emergency. The Tenant will report any damage or needed repairs promptly and pays for damage they or their guests cause beyond normal wear and tear.

7. Ending the agreement

When the agreement ends, the Tenant will remove their belongings, leave the room clean and return all keys. This agreement is governed by the laws of [Governing law]; where local rental law gives the Tenant more rights, that law applies.

Questions

What is the difference between a room rental agreement and a lease?

A lease usually covers a whole home. A room rental agreement covers one room plus shared use of the kitchen, bathroom and living areas, and adds house rules for living together.

Is a room rental agreement legally binding?

Yes, if both sides sign it, though local rental law still applies and can give the renter rights the agreement does not mention, such as notice periods and deposit rules.

How should utilities be split?

Either include them in the rent, which is simpler, or agree a percentage of each bill. Say which bills are covered and how quickly the renter pays their share.

Is it really free?
