RENT PAYMENT PLAN AGREEMENT

This Rent Payment Plan Agreement is made on [Agreement date] between [Landlord name] (the "Landlord") and [Tenant names] (the "Tenant") about the lease for [Property address] (the "Lease").

1. Amount owed

The Tenant and the Landlord agree that, as of [Balance as of date], the Tenant owes [Past due balance] in unpaid rent and [Past due fees] in fees under the Lease (the "Past-Due Amount").

2. Payment plan

The Tenant will pay the Past-Due Amount in these instalments, in addition to the regular rent due under the Lease:

Payments are made by [Method of paying]. The Tenant may pay more, or pay off the Past-Due Amount early, at any time.

If the Tenant makes every instalment and every regular rent payment on time, the Landlord waives the late fees on the Past-Due Amount.

3. Missed payments

If the Tenant misses an instalment or a regular rent payment by more than [Grace days] days, the Landlord may end this plan by written notice, and the remaining Past-Due Amount becomes due as the Lease and the law allow. While the Tenant keeps to this plan, the Landlord will not start eviction proceedings for the Past-Due Amount.

4. Everything else stays the same

This agreement changes only the timing of the Past-Due Amount. All other terms of the Lease continue, and neither party gives up any right except as this agreement says. This agreement is governed by the laws of [Governing law].

Questions

What should a rent payment plan include?

The exact amount owed and up to what date, each instalment date and amount, that current rent must also be paid on time, what happens if a payment is missed, and that the lease otherwise stays the same.

Does a payment plan stop an eviction?

It usually means the landlord agrees not to evict for the past-due amount while the tenant keeps to the plan. Local law and any rental assistance programme may add rules, so check them.

How long should a rent payment plan last?

Long enough to be affordable on top of the regular rent, often 3 to 6 months. A plan the tenant cannot keep helps nobody.

Is it really free?
