ROOMMATE AGREEMENT

This Roommate Agreement is made on [Agreement date] between the following people who share the home at [Property address] (each a "Roommate"):

This agreement is between the Roommates only. It does not change the lease, and each Roommate remains responsible to the landlord as the lease says.

1. Rent

The total rent is [Total rent] a month. Each Roommate pays their share to [Collector name] by [Share due by] each month, and [Collector name] pays the landlord.Each Roommate pays their share directly to the landlord, on the date the lease requires. A Roommate who pays late covers any late fee the landlord charges because of it.

2. Security deposit

The security deposit of [Deposit amount] was paid [Deposit split terms]. When the landlord returns the deposit, it will be shared in the same way, after taking the cost of any damage caused by one Roommate out of that Roommate's share.

3. Utilities and shared costs

Shared household costs, including [Shared costs list], are split [Costs split]. [Bills manager name] will set up the accounts and tell each Roommate their share, which is due within [Bill payment days] days.

4. Living together

Quiet time is [Quiet period]. Overnight guests may stay no more than [Guest night limit] nights a month unless the other Roommates agree.

Pets are allowed, if the lease permits, as follows: [Pet terms]No pets without the agreement of all the Roommates and the landlord.

5. Moving out

A Roommate who wants to leave before the lease ends will give the others at least [Move out notice days] days' written notice, and will keep paying their share of the rent until a replacement approved by the other Roommates and the landlord moves in, or the lease ends, whichever is earlier.

6. Disagreements

The Roommates will try to settle disagreements by talking to each other first, at a house meeting held [Meeting frequency].

Questions

Is a roommate agreement legally binding?

It can be, as an agreement between the roommates about things such as rent shares and bills. It does not change the lease with the landlord: if you are all on the lease, the landlord can usually still claim the full rent from any one of you.

Do we need one if we are all on the lease?

It still helps. The lease covers your relationship with the landlord; a roommate agreement covers how you split rent, bills and chores, and what happens if one of you leaves early.

What if a roommate wants to leave early?

The template sets a notice period and can require the roommate who leaves to keep paying their share until an approved replacement moves in. Check whether the landlord must approve a new tenant too.

Is it really free?
