RESIDENTIAL LEASE AGREEMENT

This Residential Lease Agreement (the "Lease") is made on [Lease date] between [Landlord name] ("Landlord") and the following tenant or tenants (together, "Tenant"):

If there is more than one tenant, each is responsible for all of Tenant's obligations under this Lease, including the full rent.

1. Property

Landlord rents to Tenant the home at [Property address] (the "Property"), together with the following furnishings: [Furnishings list].

2. Term

The tenancy starts on [Start date] and continues from month to month. Either party may end it by giving the other at least [Termination notice days] days' written notice, or any longer notice the law requires.The Lease starts on [Start date] and ends on [End date]. If Tenant stays after the end date with Landlord's agreement, the tenancy continues from month to month on the same terms until either party gives at least [Termination notice days] days' written notice, or any longer notice the law requires.

3. Rent

Tenant will pay rent of [Monthly rent] a month, in advance, due on day [Due day of month] of each month, by [How paid]. For the first partial month, Tenant will pay [Prorated rent] on or before [Start date].

If rent is not received within [Grace days] days after it is due, Tenant will pay a late fee of [Late fee amount], or any lower amount the law allows.

4. Security deposit

Before moving in, Tenant will pay a security deposit of [Deposit amount]. Landlord will hold it as the law requires. After Tenant moves out and gives a forwarding address, Landlord will return the deposit, with an itemized list of any deductions, within the time the law allows. Deductions may cover unpaid rent, cleaning needed to return the Property to its condition at the start, and damage beyond normal wear and tear. Tenant may not use the deposit as the last month's rent.

5. Utilities

Tenant pays for [Tenant utilities]. Landlord pays for [Landlord utilities].

6. Occupants and guests

Only Tenant and [Other occupants] may live at the Property. A guest may not stay more than [Guest stay days] days in any six months without Landlord's written consent.

7. Pets

Tenant may keep [Pet description] at the Property. Tenant will pay an additional pet deposit of [Pet deposit amount], held and returned on the same terms as the security deposit. Tenant is responsible for any damage or disturbance the pets cause.No pets are allowed without Landlord's written consent. This does not apply to assistance animals the law requires Landlord to allow.

8. Smoking

Smoking is allowed only [Smoking areas].No smoking or vaping is allowed anywhere inside the Property.

9. Care, repairs and alterations

Tenant will use the Property only as a private home, keep it clean and safe, and tell Landlord promptly about any repair that is needed. Tenant will pay for damage caused by Tenant, other occupants or guests, apart from normal wear and tear. Landlord will keep the Property fit to live in and make other repairs within a reasonable time. Tenant is also responsible for [Tenant maintenance tasks].

Tenant will not make alterations, paint, or add or change locks without Landlord's written consent.

10. Entry by Landlord

Landlord may enter the Property to inspect it, make repairs or show it to others after giving at least [Entry notice hours] hours' notice, or any longer notice the law requires, at reasonable times. Landlord may enter without notice in an emergency.

11. Subletting

Tenant may sublet the Property or assign this Lease only with Landlord's written consent, which Landlord will not unreasonably withhold.Tenant may not sublet any part of the Property or assign this Lease.

12. Disclosures

Lead warning statement: Housing built before 1978 may contain lead-based paint. Lead from paint, paint chips, and dust can pose health hazards if not managed properly. Lead exposure is especially harmful to young children and pregnant women. Before renting pre-1978 housing, lessors must disclose the presence of known lead-based paint and/or lead-based paint hazards in the dwelling. Lessees must also receive a federally approved pamphlet on lead poisoning prevention.

The Property was built before 1978. Landlord has given Tenant the lead-based paint disclosure, any records or reports Landlord has, and the pamphlet "Protect Your Family From Lead in Your Home", as federal law requires.

Landlord will give Tenant any other notices and disclosures that the law requires where the Property is located.

13. Moving out

At the end of the tenancy, Tenant will return all keys and access devices, remove all belongings, and leave the Property clean and in the same condition as at the start, apart from normal wear and tear.

14. General

This Lease is the whole agreement between the parties about the Property. Any change must be in writing and signed by Landlord and Tenant. If any part of this Lease is invalid, the rest remains in force. This Lease is governed by the law of the place where the Property is located, and where that law gives Tenant greater rights, that law applies.

Notices under this Lease must be in writing and given to Landlord at [Landlord notice address] and to Tenant at the Property, or by email to [Landlord email] and [Tenant email].

Questions

Is this lease valid in every state?

It is a general lease that covers the terms most leases share. States and cities add their own rules, such as limits on deposits and late fees, notice periods, and required disclosures, and those rules apply whatever the lease says. Check the rules where the property is, and add any required disclosures or addenda.

What disclosures does a landlord have to give?

For homes built before 1978, federal law requires a lead-based paint disclosure, a lead warning statement in the lease and the EPA pamphlet. Many states add their own, such as mold, flood risk, bed bugs or the deposit bank. The lease has a paragraph for lead paint and a place to list any others.

Should I choose a fixed term or month to month?

A fixed term, usually a year, gives both sides certainty about the rent and the dates. Month to month is flexible, and either side can end it with notice. The template covers both, and a fixed-term lease can roll into month to month at the end.

Is it really free?
