NANNY AGREEMENT

This Nanny Agreement is made on [Agreement date] between [Parent names], of [Family address] (the "Family"), and [Nanny name] (the "Nanny"). The Nanny's employment starts on [Start date], with a trial period of [Trial period weeks] weeks during which either side may end it with one week's notice.

The Nanny will never leave the children unattended, will follow the Family's instructions on meals, screen time, naps and discipline, and will call emergency services first and then the parents in an emergency.

3. Hours and pay

The Nanny works [Work schedule], about [Weekly hours] hours a week. The Family pays [Hourly rate] an hour, paid [Pay frequency]. Hours worked over 40 in a workweek are paid at one and a half times the hourly rate.The Nanny lives in the Family's home, and overtime is paid as the law of [Governing law] requires.

The Family is the Nanny's employer. It will withhold and pay the employment taxes that the law requires and give the Nanny the year-end tax forms the law requires.

4. Time off

The Nanny receives [Paid vacation days] days of paid vacation and [Paid sick days] paid sick days each year, and these paid holidays: [Paid holidays]. If the Family cancels a scheduled day, the Nanny is paid for it.

5. Driving

The Nanny may drive the children in the Family's car, which the Family insures and maintains in the Nanny's own car, which the Nanny keeps insured; the Family reimburses mileage at [Mileage rate] a mile. Children always ride in age-appropriate car seats.The Nanny will not drive the children.

6. Privacy

The Nanny will keep the Family's private information confidential and will not post photos of the children or the home on social media without the parents' written permission. The Family has told the Nanny that there are cameras in these areas of the home: [Camera locations].

7. Ending the agreement

Either side may end this agreement by giving [Notice weeks] weeks' written notice, or pay instead of notice. The Family may end it at once for serious misconduct, such as endangering the children. This agreement is governed by the laws of [Governing law].

Questions

Is a nanny an employee or a contractor?

In the US a nanny who works in your home on your schedule is usually your household employee, not a contractor. If you pay $3,000 or more in cash wages in 2026, you generally owe Social Security and Medicare taxes and must give the nanny a Form W-2.

Do nannies get overtime?

Under federal law a nanny who does not live in your home must be paid one and a half times their rate for hours over 40 in a workweek. Live-in nannies are exempt from federal overtime, but some states, such as California and New York, still require it.

What should a nanny contract include?

The children and duties, the schedule and pay, overtime, paid time off, what happens on days the family cancels, driving rules, privacy and cameras, and how much notice each side gives to end it.
